Scope of Application
These General Terms and Conditions (GTC) apply to all service orders concluded between the client and ev film.

These terms are intended to define the conditions of sale between ev film and the couple, from the order to the service, including payment and delivery.

They govern all the necessary steps in placing the order and ensure follow-up of this order between the contracting parties.

Any service request made by the couple will result in the preparation of a prior offer submitted by ev film for acceptance in the form of a signed contract outlining the details of the service.

Any offer is valid for one (1) month from the date of submission.

ev film, located at 25 rue Alexandre – 80000 Amiens, represented by Emmanuel VANDOMME (sole proprietor – VAT not applicable under article 293 B of the French General Tax Code), videographer, hereinafter referred to as “ev film“.

Any booking must be confirmed by a signed contract from the clients or their appointed representative. The contract becomes valid only upon receipt of the deposit, at which point the date is officially reserved.

Article 1 – Obligations of the parties

ev film agrees to make its best efforts, under a best-effort obligation and within the limits of what is reasonably possible, to achieve the intended result.

In the case of a religious ceremony, regardless of the faith, the clients agree to obtain prior consent from the person in charge of the liturgical service regarding the authorization to photograph/film. In the event of a refusal, ev film cannot be held responsible for not performing its services during that part of the ceremony. ev film commits to performing its work discreetly, without disrupting the ceremony or disturbing the family and guests.

During the evening reception, if a mutual agreement cannot be reached between the DJ and ev film regarding the use of lasers during the first dance, ev film reserves the right not to film. Laser use is regulated, as they may be harmful to the human eye and can cause irreversible damage to the camera sensor.

Delivery time for the short and/or long film: between 1 and 2 months from the day after the wedding.

In the case of complaints about the videos, clients must notify ev film within 8 days of receiving the final files. After this period, the work will be deemed accepted.

No final video will be delivered before full payment of the outstanding balance.

Any rejected check may result in cancellation of the present contract and the withdrawal of ev film. No refund of any previously collected amounts may be claimed. The deposit constitutes the first installment toward the total service price and signifies a firm and irrevocable commitment by both parties.

The clients acknowledge having booked ev film with full knowledge and acceptance of its filming and editing style (framing, color grading, editing…), and understand that no complaints will be accepted on these matters. If the client requests modifications to the videos (color changes, re-editing, etc.), a new quote and/or invoice may be issued. ev film is solely responsible for determining whether additional fees apply.

The video(s) delivered by ev film are selected and edited. Raw footage may be made available to the clients upon request, provided they supply a hard drive with sufficient storage capacity.

Article 2 – Image Rights

The clients agree that some video excerpts may be used for ev film’ communication purposes (website, brochures, promotional portfolio at trade shows, etc.), with the understanding that these will never be used in a way that could harm the people represented. The clients agree to inform all individuals concerned of the videographer’s presence on the day of the event.

No use will be made by ev film beyond its own communication needs.

Article 3 – Modifications / Cancellations

Any additional service not specified in the present contract must be formalized within 15 days following the client’s request. The payment for this additional service may be collected at the same time as the remaining balance, and no later than 15 days after the wedding day.

It is possible to request an extension of filming time on the evening of the event, verbally, in case of delay. This request must be made solely by the couple or the official clients. The rate for exceeding the contracted service time is €150/hour – this additional fee must be paid no later than 15 days after the wedding day.

Any signed contract is irrevocable for both the clients and ev film, unless mutually agreed otherwise. Any client request for changes will only be considered if submitted in writing (by mail or email) no later than one month before the scheduled date of service, and subject to ev film approval. Requests to downgrade the service from what is indicated in the contract will not be accepted.

In accordance with current laws, if the contract is signed at home, the clients are entitled to a 7-day cancellation period without financial penalty. The cancellation must be sent by registered mail with return receipt within this time frame (postmark as proof).

Cancellation by the client less than six (6) months before the event date results in the loss of the deposit. Cancellation less than one (1) month before the service date results in full payment of the agreed service.

In the event of force majeure that prevents ev film from fulfilling its obligations, the clients will be immediately informed and the deposit refunded in full. ev film will do its best to suggest an alternative videographer.

Article 4 – Force Majeure

Unless otherwise specified in writing by ev film, a service will not be canceled due to unfavorable weather conditions.

Despite all reasonable precautions taken by ev film for data storage, it is possible — in exceptional cases — that files become unusable due to accidental handling, unintentional deletion, or hardware failure. In such an event, ev film will offer to redo the shoot within the limits of the agreed service. Likewise, despite all due care in storing video files, in the case of loss or theft of raw video files, no charge will be made to the client; all amounts paid will be refunded.

However, the client may not hold ev film liable. No compensation other than reimbursement of the unused service will be provided.
